These terms and conditions apply to all orders placed through our online shop www.oretvin.com .

By placing an order, the customer agrees to these terms and conditions.

Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the "Buy now" or "Submit order" button, the customer makes a binding offer to purchase the selected goods.
We can accept this offer by sending an order confirmation via email or by shipping the goods. The contract is only concluded upon such acceptance.

Prices and Payment

All prices are quoted in euros (EUR) and include statutory VAT.
Any applicable shipping costs will be shown separately during the ordering process.
Payment is made via the payment methods offered during the ordering process, currently PayPal and Shopify Payments.
The purchase price is due immediately upon conclusion of the contract.

Shipping and delivery

We deliver within Germany and to countries of the European Union.
Delivery times depend on the respective shipping provider and are displayed during the ordering process.
Shipping costs will be displayed before you complete your order.
If the customer provides an incorrect or incomplete delivery address, he shall bear the resulting additional costs.
The risk of accidental loss or accidental damage to the goods passes to the consumer upon delivery.

Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days.
Details regarding the right of withdrawal, including instructions on withdrawal and a sample withdrawal form, are listed separately on the "Right of Withdrawal" page of our website.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (§ 312g para. 2 no. 3 BGB).
This applies in particular to perfumes and cosmetic products that have been opened or whose original seal is damaged.

Returns and refunds

Returns are only accepted for products that are unused and in their original sealed condition.
If the customer exercises their right of withdrawal, they bear the direct costs of the return shipment.
Refunds will be issued within 14 days after we have received and inspected the returned goods.
Refunds will be issued via the same payment method used for the original transaction, unless otherwise agreed.

Warranty

The statutory warranty rights apply.
In the case of defective goods, the customer is entitled to the statutory rights to rectification, replacement delivery, price reduction or withdrawal from the contract.

Liability

We are fully liable for damages caused intentionally or through gross negligence.
In cases of simple negligence, we are only liable for damages resulting from injury to life, body or health, as well as for breaches of essential contractual obligations.
Any further liability is excluded to the extent permitted by law.

Data protection

Personal data is processed exclusively in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR).

Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection regulations of the state of their habitual residence remain unaffected for consumers.

Jurisdiction

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our place of business.
For consumers, the statutory places of jurisdiction apply.

Severability clause

Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
